- 200 grams to 400 grams: Life felony, 10 to 99 years in jail and $100,000 in fines.
- More than 400 grams: Life felony, 15 to 99 years behind bars and $250,000 in fines.
In addition, Texas Penal Code 19.02(b)4 now authorizes the use of murder charges arising from the manufacture or delivery of fentanyl when an overdose results in death.
