Know The Law – Protect Your License To Drive

If you are arrested for DWI, your driver’s license will automatically be suspended. For many, the loss of driving privileges associated with a DWI arrest is troubling. The ability to pick up the kids, drive to and from work, and pick up groceries is severely compromised from a license suspension.

For a first-time DWI arrest, the suspension period is 90 days if the chemical test returned a reading of .08 BAC. In cases where law enforcement alleges a driver refused a breath or blood test, the suspension for a first-time offense is 180 days. For repeat offenses, the suspension periods are longer.

There Is No Time To Wait After A DWI Arrest

It is often the tendency of individuals accused of DWI to wait to consult with an attorney. Unfortunately, Texas law only allows you 15 days after receiving notice of the automatic license suspension to file the appropriate paperwork to request an ALR hearing with the Department of Public Safety to challenge the suspension. Police generally provide the notice during the arrest process.

If you miss the deadline, your privilege to drive will be automatically suspended, regardless of what may happen with the criminal charges.
